ACCEPTANCE OF TERMS

By accessing, attending, downloading or using services provide by The You Project Pty Ltd (ABN: 12600835523), you agree to be bound by these terms, which you acknowledge that you have read and understood.

We reserve the right, at our sole discretion, to change, modify or otherwise alter these terms at any time. We recommend that you review these terms on a regular basis to keep yourself informed of any changes.

These terms apply to all products, programs, events and services sold on this site or any other site owned by The You Project Pty Ltd.

CANCELLATIONS

‘Cancellation’ is defined as not attending a program or event including postponing or rescheduling. Naturally, no one books with the intention of cancelling or postponing, but unexpected things do happen, so please consider purchasing travel cancellation insurance if you are planning on travelling to an event.

Depending on when you cancel, cancellation fees may apply. Fees are determined by the following schedules:

The You Project Conference, Mentoring Program and Craig Harper Live Events Cancellation Policy

If you cancel 7 days or more before the event date, you will be refunded the full amount.

If you cancel less than 7 days prior to the event, you will forfeit the full amount.

Many of our events have a limited capacity and sell out well in advance. We therefore require a minimum 7 days notice in order for you to qualify for a full refund. We do not offer credit for arriving late, leaving early or missing a session.

Weekend Transformation Program Cancellation Policy

Depending on when you cancel, cancellation fees may apply. Fees are determined by the following schedule:

If you cancel 45 days or more before the program start date, you will be refunded the full amount.

If you cancel 15 – 45 days before the program start date, you will be refunded 50% of your payment. You will forfeit 50% of the price of the Program.

If you cancel 14 days or less before the program start date, you will forfeit the full amount.

Due to our need to commit to accommodation and other arrangements in advance, exceptions to our policy cannot be made. We do not offer credit for arriving late or leaving early.

Online Program Cancellation Policy

As access to the content of our online programs is granted upon purchase, refunds will not be issued for cancellations.

Cancellation of Events

While we have no intention of cancelling any program or event, if we must cancel or change the program dates for any reason whatsoever, you are entitled to transfer your full payment to another event (either scheduled or at some future time). Alternatively, you may request a refund of your payment.

You may wish to take out travel insurance as we will not be held responsible for any expenses incurred in preparation for the cancelled event/program, such as other accommodation, airline tickets, loss of work, and/or other costs associated with preparing for your trip.

GENERAL WAIVER

You acknowledge that you participate voluntarily in any and all activities arranged, and insofar as legally permissible, surrender your right to any cause of action against The You Project Pty Ltd arising from any loss or damage to person or property that occurs during our programs and events. You agree to indemnify and hold harmless The You Project Pty Ltd and any affiliated organisations, and its directors, officers and employees from any claim or demand including reasonable legal fees, made by any third party due to or arising out of your use of our services.

GENERAL ADVICE

Any information delivered as part of our products, programs, events and services constitutes general advice only and is not a personal prescription. We recommend you seek the advice of an appropriate qualified professional when required.

THIRD PARTIES

The You Project Pty Ltd holds no responsibility for the actions or omissions of third parties or independent contractors.

PHOTOGRAPHIC WAIVER

On occasion, we may take photos and video footage during our programs and events. By agreeing to these terms, you understand and give permission for photos and videos to be taken. You agree to release and discharge The You Project Pty Ltd from any and all claims and demands arising out of or in connection with the use of the photographs and video footage.

SOCIAL MEDIA

We want people to feel safe when interacting on our online education and social media platforms. For that reason, comments that are considered to be inappropriately negative, rude, or attacking will be deleted.

BEHAVIOUR

For the safety and wellbeing of all participants, any aggressive or intimidating language or behaviour will not be tolerated. Anyone who chooses to engage in such behaviour may be asked to leave.

PRIVACY

The You Project Pty Ltd is committed to the protection of personal information provided to us. We follow various principles concerning the collection, storage and use of personal information as contained in the Privacy Act (1988)(Cth). FEEDBACK

We welcome enquiries or feedback on our products, programs and services. Unless specifically stated by you, we shall treat any information you provide us with, as non-proprietary and non-confidential.

INTELLECTUAL PROPERTY

You agree that the services, images, audio clips, video clips, and written content used by The You Project Pty Ltd contains proprietary information and material that is owned by The You Project Pty Ltd, and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for in compliance with this Agreement. No portion of The You Project Pty Ltd content may be reproduced in any form or by any means, without expressed written permission from The You Project Pty Ltd. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on The You Project services in any manner, and you shall not exploit the The You Project Pty Ltd (incorporating the Craig Harper brand) in any unauthorized way whatsoever.

APPLICABLE LAW

These Terms and Conditions shall be construed and governed by the laws of Victoria, Australia. Further, any dispute arising from these Terms and Conditions or a breach of any agreement between us and you will be governed by the laws of Victoria, Australia. As a user of this website and our services you submit to the exclusive jurisdiction of the courts of Victoria, Australia and the federal courts of Australia.
